License agreement
Draft. This text is not final. It is not yet a legal agreement.
This agreement is between you and ModalJazz LLC ("we"). It applies when you install or use ModalJazz ("the app").
1. The unregistered version
You can use the app without a license, with all features and with no time limit. The unregistered app shows "(unregistered)" in the window title and asks you now and then to buy a license. It adds a line at the bottom of exported and printed pages.
2. The license
A license is for one named person. That person can use the app on every computer where they are the main user. A license is not for a company or a school where several people use the app.
The license key holds your email address. Do not share your key with other people.
3. The update period
A license includes all versions that we release in the 2 years after the purchase (the "update period"). You can use those versions for ever, with no limits. Versions released after the update period need a renewal.
A renewal adds 2 years to the update period. The new period starts on the later of two dates: the end of the current period, or the date of the renewal.
4. Your music
The scores that you make with the app are yours. This is also true for pages with the line of the unregistered version. That line is not a claim on your music.
5. What you must not do
- Do not sell, rent, or give away copies of the app or of a license key.
- Do not change the app to remove the reminders without a license.
6. The sale
Paddle.com is our reseller and the merchant of record. Paddle's buyer terms apply to the payment, taxes, and refunds. Our refund policy adds to those terms: you can get a full refund within 30 days.
7. Our promise about the app
We promise that the app works substantially as its documentation on modaljazz.com describes. If it does not, tell us within 90 days of your purchase. We then fix the problem, or we give you a full refund. This is your only remedy under this promise.
The app can contain errors. An error that does not stop the app from working substantially as described is not a breach of this promise.
To the limit that the law allows, we give no other warranty, written or implied.
8. Limit of liability
To the limit that the law allows, we are not liable for loss of data, or for indirect or consequential loss, from the use of the app. Our total liability is limited to the amount that you paid for your license. Keep copies of your important scores.
9. Your rights under the law
Nothing in this agreement takes away a right that consumer law gives you.
10. Third-party parts
The app contains open-source software and fonts under their own licenses. The app lists them in Help > Acknowledgements.
